THE RIGHT TO STOP INDEFINITE DETENTION

Image by UNARMED CIVILIAN via Flickr

NextNewsNetwork·Feb 26, 2013

The NDAA has been called the death of our republican form of government. That acronym refers to the National Defense Authorization Act of 2012, which contains a provision allowing the president to order the indefinite military detention of anyone accused of offering substantial support to al-Qaeda or “associated forces.”

Mario Cuomo, commenting on the political process, once observed, “You campaign in poetry. You govern in prose.” Though candidates for public office frequently campaign on a platform of change, when elected, promises remain unfulfilled and what they inevitably deliver is more of the same. Beholden to the special interests and the Super PACS, they govern solely in the interest of the wealthy and the privileged, and remain blatantly unresponsive to the general will, the needs of the majority of the people, and to the dictates of law and morality. On Wednesday a few hundred activists crowded into the courtroom of the Second Circuit, the spillover room with its faulty audio feed and dearth of chairs, and Foley Square outside the Thurgood Marshall U.S. Courthouse in Manhattan where many huddled in the cold. The fate of the nation, we understood, could be decided by the three judges who will rule on our lawsuit against President Barack Obama for signing into law Section 1021(b)(2) of the National Defense Authorization Act (NDAA).

As I head west on Chambers Street toward the Court House I hear a huge roar followed by loud chanting ricocheting off the stone walls of the buildings and I’m elated. This is amazing, I think. There must be hundreds of people protesting the NDAA outside 40 Centre Street. But then I realize the protest is the transit workers’ school bus strike, now in its third week. I stop to take a few photos and give them a thumbs up before continuing along my route.
