Naomi Wolf, in her fine 2007 book The End of America, hit the nail on the head. She mentions, in her preface, that Nazi propagandists were referring to Germany as ‘ The Heimat ‘ or ‘ Homeland ‘ . Is it a coincidence that the Bush crew used this phrase after 9/11? Hitler’s gang, after the suspicious Reichstag fire, got the German Parliament to pass the Enabling Laws. These laws virtually gave unlimited power to the government, stripping away civil liberties. They disallowed the right to dissent, freedom of assembly, freedom of the press…while legitimizing the arrest of political opponents to the regime. Those deemed enemies of the state were held in custody indefinitely without the right of habeas corpus. Without needing court orders, the government would tap phones and open mail. Continue reading

Six months ago this week President Obama, on his second day in office, promised to close the Guantánamo detention camp within a year, and to undo the secretive and coercive detention and interrogation policies of George W. Bush. But has Obama been as good as his word?

As the military handlers made pleasant jokes about the heat, I took in a low-tech vision of Hell. This was the site of the first scenes from Guantánamo, where men sweltered in kennel-like cages. These were the cages themselves: about 50, each about 8ftx12ft, an aisle down the centre for guards to move in, a slab of corrugated iron on top of each cell, and a pipe with a funnel at groin level, in which to urinate; open to the elements; no walls, no true shade. Concrete floors. There had been buckets for defaecation, MC1 Dwight told us; but the prisoners had thrown the faeces at the guards. There was a communal shower, now crumbling — but the prisoners had not liked to shower in groups, naked.

The Telegraph of London broke the news – because the US press is in a drugged stupor — that the photos Obama is refusing to release of detainee abuse depict, among other sexual tortures, an American soldier raping a female detainee and a male translator raping a male prisoner. The paper claims the photos also show anal rape of prisoners with foreign objects such as wires and lightsticks. Major General Antonio Taguba calls the images `horrific’ and `indecent’ (but absurdly agrees that Obama should not release them – proving once again that the definition of hypocrisy is the assertion that the truth is in poor taste).

Predictably, a few hours later the Pentagon issues a formal denial.

As citizens’ outrage over the torture memos heats up, and the US Congress is barraged with calls to appoint a special prosecutor, Americans may be about to commit an egregious miscarriage of justice. Republicans have now accused Democrats in Congress of having “blood on your hands too” in relation to the escalating calls to investigate. I would go further: not only do Congressional Democrats have blood on their hands – but so do we, the American people. And CIA agents may be about to be sacrificed to assuage their – and our – actual and associative guilt.

The suddenly urgent calls by our Congressional Democratic leaders, and even by many of the American people, to prosecute CIA operatives, military men and women and contractors who were certainly involved with, colluded in or turned a blind eye to torture are not only the height of hypocrisy, they are a form of unconscionable scapegoating. The scapegoating is political on the part of Congressional leaders, and psychological on the part of many Americans who are now “shocked” at what was done in their name.

If history gets this recent era right, future textbooks will have to show that the US narrowly averted a carefully planned but thorough and unmistakable conspiracy to subvert the rule of law and the process of democracy from 2001-2008. For three years, since writing End of America, I have been arguing that the Bush team sought irretrievably to subvert our liberty. Fortunately, this appalling and conceivably irrevocable subversion of the tenets of freedom was narrowly averted by citizens at every level — from the grassroots to the courts — resisting in time. But the release this week by the Justice Department of the “secret memos” sought valiantly by the ACLU confirms that Bush’s legal architects were building up the framework for something even scarier than our most anguished projections.

You can see the documents themselves online — but, as usual, there is a gap between the cautious journalistic interpretation of the event and the dense legalese in which they are written, and no one yet has really explained to citizens who are not attorneys what these memos claimed to give Bush the right to do. This is my initial reading of these documents:

A set of nine secret memos released by the US Justice Department Monday reveal that in the weeks and months after the September 11, 2001, terrorist attacks the US government began erecting the legal scaffolding for a full-blown military dictatorship.

Attorney General Eric Holder declared that the release of the documents, which were posted on the Justice Department’s web site, signaled a new era of “transparency and openness.” The actions of the Obama administration in recent weeks, however, including the invocation of national security and state secrets to quell lawsuits challenging the worst abuses of the Bush era, make it clear that the threat revealed in these memos is far from over.
