Former Bush White House Deputy Chief of Staff Karl Rove was deposed by lawyers for the House Judiciary Committee, Judiciary Chairman John Conyers (D-MI) said in an interview Tuesday.

Rove’s deposition took place over a period of some eight and a half hours, beginning at 10 a.m. and ending around 6:30 p.m, ET — and the lawyers took several breaks, Conyers said.

The chair of the House Judiciary Committee, John Conyers, has subpoenaed former White House adviser Karl Rove to testify next week about the Bush administration’s firing of nine US attorneys and the prosecution of former Alabama governor Don Siegelman. Rove previously refused to appear before the panel, and former President Bush upheld his legal position. Rove’s attorney, Robert Luskin, said he would consult with President Obama’s White House counsel to determine the Obama administration’s stance. Conyers Subpoenas Karl Rove: “It’s Time to Talk”

(Washington, D.C.) — Today, House Judiciary Committee Chairman John Conyers, Jr. issued a subpoena to Karl Rove requiring him to testify regarding his role in the Bush administration’s politicization of the Department of Justice, including the U.S. attorney firings and the prosecution of former Alabama Governor Don Siegelman. The subpoena was issued pursuant to authority granted in H.R. 5 (111th Congress), and calls for Mr. Rove to appear at deposition on Monday, February 2, 2009. Mr. Rove has previously refused to appear in response to a Judiciary Committee subpoena, claiming that even former presidential advisers cannot be compelled to testify before Congress. That “absolute immunity” position was supported by then-President Bush, but it has been rejected by U.S. District Judge John Bates and President Obama has previously dismissed the claim as “completely misguided.”

“I have said many times that I will carry this investigation forward to its conclusion, whether in Congress or in court, and today’s action is an important step along the way,” said Mr. Conyers. Noting that the change in administration may impact the legal arguments available to Mr. Rove in this long-running dispute, Mr. Conyers added “Change has come to Washington, and I hope Karl Rove is ready for it. After two years of stonewalling, it’s time for him to talk.”

A constructive critic might say: “Hey, you draw entirely from the Siegelman appeal, but you do not include information from the prosecution’s response.”

That’s a point well taken. And there are two reasons for the lack of response from the prosecution side. One, I don’t have a copy of their response. But more importantly, I don’t think I would trust it if I did have a copy.

I’ve seen the Bush Justice Department at work enough to know that even career prosecutors seem to be more interested in pushing a political agenda than in seeing to it that justice is done.

In a new installment of Bush League Justice today, guest Julian Epstein, former counsel to the House Judiciary Committee, stated that Republicans will admit, off-camera, that the case against former Alabama Governor Don Siegelman was fixed.

The segment concentrated on Karl Rove finally giving written answers to questions, NOT under oath, about the Siegelman case. The questions, which were posed by Lamar Smith (R-TX), and answers can be read at Talking Points Memo.

While the general consensus is that the softball questions were a “pathetic attempt to save Karl Rove“, the effort appears to have failed. In the video above, Epstein states that Rove actually appears to “incriminate” himself by refusing to answer a specific question about whether he contacted non-state officials.

Marcy Wheeler agrees with Epstein over at emptywheel:

In a classic non-denial denial, Karl Rove makes it clear that he did talk to people about Siegelman’s prosecution–even while he denies that he spoke to anyone in DOJ about it.

And Larisa Alexandrovna thinks “This is getting to be rather fun” before proceeding to rip apart Rove’s answer with the facts. She also poses six real questions she’d like to see asked of Rove.

Mississippi US Attorney said to share tax returns of one of his targets with “unauthorized personnel”

The US Justice Department’s Office of Professional Responsibility (OPR) is investigating the conduct of at least two specific US Attorneys in the “selective prosecution” of former Alabama Governor Don Siegelman, sitting Mississippi Supreme Court Justice Oliver E. Diaz Jr., and Mississippi attorney Paul Minor, according to attorneys close to the investigation.

In a May 5 letter sent to House Judiciary Committee chairman John Conyers (D-MI), OPR Director H. Marshall Jarrett wrote that OPR “currently has pending investigations involving, among others, allegations of selective prosecution relating to the prosecutions of Don Siegelman, Georgia Thompson, Oliver Diaz and Paul Minor.”

Don Siegelman: Former Alabama Democratic Governor Don Siegelman was defeated in the 2002 Alabama gubernatorial race by Republican Bob Riley. A consultant to Riley’s campaign, Bill Canary, is a long-time business associate of Karl Rove, former White House Deputy Chief of Staff and senior aide to the president.

Canary’s wife, Leura Canary, was appointed to be the US Attorney for the Middle District of Alabama by President George W. Bush. Ms. Canary’s office investigated Siegelman on charges of bribery and corruption, twice allegedly timing indictments for maximum impact on upcoming elections. Ms. Canary has stated that she recused herself from the Siegelman case, but no evidence has been furnished by the Justice Department to prove that Ms. Canary did in fact recuse herself.

“Rove’s dream was to recreate the landscape of the judicial system, and to install judges that were either pliable, malleable, and/or very, very pro-corporation. Essentially that is what he did in Alabama in the early Nineties. That is what this is all about. If you control the governor in the states where the justices are not elected, you control who gets on the supreme court. And that’s essentially what this is all about for Rove ultimately. But to get those kinds of things done, you have to eliminate the governor you don’t want and install the governor you do want. There are a lot of corporate interests funding this. So it intersects in that sense. It’s buying the law and restructuring the state judiciary.” — Larisa Alexandrovna

Alexandrovna was born in the Soviet Union and knows a thing or two about people getting framed by the state. So, among her many investigative projects, she became drawn to the plight of one Don Siegelman, the former Democratic governor of Alabama, who became an apparent victim of the DOJ “Prosecutor-Gate.” His sin was protesting an election that appears to have been stolen from him, literally, in the dead of night.

If you think that “Prosecutor-Gate” ended with the resignation of Alberto Gonzales, you are wrong. Siegelman is only out of jail after a lengthy campaign to get him released on bond while his case is on appeal. Karl Rove still is at large and free to bloviate for dollars on the corporate media, while Siegelman has to battle to prove that he is an innocent victim of a DOJ that became a tool of partisan prosecutions.
